Terms and Conditions
For the purpose of this document, the following definitions apply:
“Us” / “We” / “Our” refers to Segway Rent Tallinn. “Segway” refers to the Segway PT’s utilized by Segway Rent Tallinn. “Segway Tours” refers the activities offered by Segway Rent Tallinn involving the use of Segway. “Instructor” / “Tour leader” refers to the employees of Segway Rent Tallinn who deliver any of the Segway Tours offered by Segway Rent Tallinn including the mandatory training in the operation of the Segway’s which is an integral part of all Tours. “You” / “Your” refers to the person making a booking for a Segway Tour, any person signing these terms and conditions from Segway Rent Tallinn. “Participant” refers to every person who participates in a Segway Tour offered by Segway Rent Tallinn.
When You make a booking for a Segway Tour with Us, You must read, understand and agree to all of the terms and conditions in this document. If You are booking on behalf of others, You are responsible for ensuring that they agree to all of the terms and conditions in this document. Before the tour, all Participants must sign a statement of risk/waiver of liability & release indicating that they understand and accept the inherent risks associated with using a Segway and that they have read and understood these terms and conditions before they will be permitted to participate in any of Our Segway Tours / Activities. If a Participant does not agree to these terms and conditions, their booking will be terminated as per the standard Termination/Cancellation Policy.
3. General terms
Tour bookings are made for a specific date and time. It is Your responsibility to arrive on time on the correct date. The latest check-in for a tour is 15 minutes before the tour. All tours begin with a mandatory training session. Even if you have been on a Segway before the training session is mandatory. If You arrive too late you will miss your training session and your Segway tour. No refund will be available. Please see Cancellation Policy. Segway Tours will operate in almost all kinds of weather; however, We reserve the right to cancel a booking if We consider the weather conditions adverse enough to affect the safety of Our Participants. If in any doubt, contact Us on the day of Your scheduled booking. Please also see Cancellation Policy. Any photographs or video material captured by Us during any of Our Segway Tours/Activities may be used by Us for promotional purposes, including, but not limited to, publication on Our website and/or Facebook page. If you have an objection to the use of photo or video material, which includes you, please let us know and we will not use it for any promotional purposes. The duration quoted for any Segway Tour is approximate and may vary depending on group size, ability and place. The distance quoted for any Segway Tour is approximate and is limited by the quoted duration. We reserve the right to amend these terms and conditions from time to time.
4. Participant requirements
Participants failing to meet any of the following requirements will not be able to participate in our Segway tour and will be subject to the standard Termination/Cancellation Policy – any queries should be raised before bookings are made:
- Participants must be at least 12 years of age.
- A parent/legal guardian or responsible adult (who has obtained consent from the parent/legal guardian) must sign a consent form for participants aged 12 to 18 years old.
- Participants must weigh at least 40 kg.
- Participants must be no heavier than 125 kg.
- Participants must wear a helmet. Helmets will be provided.
- Participants must wear suitable footwear (e.g. trainers or comfortable shoes) and clothing.
- Participants must be able to stand for the duration of their Segway Tour without stopping.
- Participants must be able to step on-to and off the base of their Segway unassisted (following training). The step is approximately 20 CM tall.
- Participants must be able to lean from side-to-side and forwards and backwards, whilst standing upright on their Segway.
- Participants must not be under the influence of drugs or alcohol.
- Participants must have adequate vision in order to safely operate a Segway, which can move at speeds up to 20 km/h, and must wear any prescribed glasses where appropriate.
- Participants must have adequate hearing (or assisted hearing) or be otherwise able to understand and respond to instructions from us.
- Participants must understand English in order to respond to instructions from us.
- Participants must inform their Instructor of any impairment, which may affect their safety before participating in Our Segway Tour.
Pregnant women, people with back injuries or other serious health problems should not participate in any of Our Segway Tours. We strongly recommend that people with underlying medical conditions such as osteoporosis, osteoarthritis, arthritis, musculoskeletal disorders (e.g. joint or back problems) or any other disorder or condition that could be exacerbated by an accidental fall from the Segway should NOT participate in our Segway tour.
5. Acceptable behaviour
Inappropriate behaviour will result in the offending Participant’s Segway Tour being terminated, as per the standard Termination/Cancellation Policy: Verbal or physical abuse against Our employees, customers, equipment, operating environment and any third parties who may be present will not be tolerated under any circumstances. This includes but is not limited to aggressive, dangerous and intimidating behavior or language. Participants are not permitted to smoke at any time whilst operating a Segway. Participants are not permitted to use mobile phones, cameras or recording equipment whilst operating a Segway, unless the Segway is stationary. Participants are not permitted to stop, fall behind, or hinder the group’s progress in order to make use of their mobile phones, cameras or recording equipment. The group will stop at several safe locations and any other requests should be agreed with the Guide. We operate to Leave No Trace Principles and ask that you respect our beautiful city of Tallinn. Participants must not drop litter at any time during their Segway Tour. Participants must follow the instructions of their Tour leader – at all times – relating to all aspects of their Segway Tour.
6. Termination and cancellation policy
Sometimes unforeseen events get in the way and so with this in mind we try to operate a simple and fair cancellation policy. Should you need to rebook or cancel a confirmed tour booking the following policy applies:
Any requests for rebooking and cancellations to your booking must be made in writing via email to Segway Rent Tallinn (the email address is firstname.lastname@example.org). Only when you receive an acknowledgement from us should you deem the rebooking or cancellation to be made. If You cancel your booking more than 14 days prior to your allotted time you have the option to reschedule your tour to a new date or request a full refund of the total amount paid. If You cancel your booking between 14 days and 2 hours prior to the scheduled booking commencing you will have the option to reschedule your tour date only (subject to availability). If you cancel your booking less than 2 hours before the tour no option for rescheduling or refund will be available. In the case of a no show no option for rescheduling or refund will be available. Reducing booking size without the above notice – You will be liable for the full payment of original booking. Should We need to cancel due to poor weather or other unforeseen circumstances we will refund the full cost of the tour you had booked with us. Please note that we will refund the tour cost only and that we will not accept responsibility for any travel arrangements or costs that may be incurred on your part. We reserve the right to prohibit any Participant, prior to commencement, during training or during operation, from participating or continuing to participate in any of Our Segway Tours, if they fail to meet the General Terms, Participant Requirements or do not maintain Acceptable Behaviour, as specified in these terms and conditions. In such cases, a Participant’s Segway Tour will be terminated and no refunds or alternative dates will be offered. Following training, if a Participant cannot control a Segway PT to the standard required by their Instructor/Tour leader, they will be unable to participate further. Any bookings made with a direct payment will be refunded upon request.
7. Liability waiver and disclaimer
There is a risk of death or injury when using a Segway. We will provide sufficient training so as to minimize all reasonable risks, however we cannot fully eliminate the risk involved in using a Segway, therefore, You acknowledge that Our Segway Tours are undertaken at Your own risk. You agree that We are not responsible for any personal injury, death, loss or damage which may occur. If You cause any damage, loss, injury or death, as a result of inappropriate actions or willful neglect, which has not resulted directly from Our negligence, You accept liability for these actions and agree to be held accountable for them. You will be required to read and sign our standard Disclaimer before participating in any of Our Segway Tours/Activities.
Refunds are only permissible as per these terms and conditions. Refunds for payments received less than 60 days ago will be made by the original payment method where possible. If a refund is due more than 60 days after the original payment was received, refunds will be made through a bank transfer.
